Hiring Employees in the UAE: What Every Global Business Needs to Know

Expanding your business to the UAE? One of your first tasks will be to hire talent in UAE — and while the talent pool is diverse, the process is governed by very specific legal and administrative requirements. Compliance to these requirements is crucial for smooth onboarding, positive employment experience and avoidance of delays, operational disruptions and punitive measures such as fines and penalties.

This blog will walk you through the key steps, rules, and tips to help you hire employees in the UAE legally, smoothly, and confidently as an international company.

🧭 Step 1: Know Which Employment Law and Regulations Applies to your organisation

In the UAE, your company’s licensing authority determines who regulates your hiring:

UAE Labour Law- Applicable to Mainland Companies and most Free zones
DIFC Employment Law – Applicable for companies in DIFC Freezone
ADGM Employment Regulations – Applicable for companies in DIFC Freezone
💡 Tip: If you’re hiring across multiple jurisdictions, you may need to work with more than one law.

🧭 Step 2: Know Who Governs Your Hiring

In the UAE, your company’s licensing authority determines who regulates your hiring:

Mainland Company: Regulated by the Ministry of Human Resources & Emiratisation (MOHRE)
Free Zone Company: Regulated by your respective Free Zone Authority (e.g., DMCC, DIFC, JAFZA, RAKEZ)
💡 Tip: If you’re hiring across multiple authorities, you may need to work with both MOHRE and the applicable Free Zone authority.

📄 Step 3: Offer Letter & Contract Approval

Before an employee starts, you must:

Generate a government-approved offer letter.
File it through your authority’s portal (MOHRE or Free Zone).
Convert it into an official UAE labor contract, which must:
Include job title, start date, work schedule, compensation, benefits, leave entitlements and notice period
Be filed electronically
🛑 Employee must only start after receiving approval by MOHRE

🛂 Step 3: Visa & Work Permit Processing

If you are hiring a foreign national, you will require to sponsor them through this process unless they are already sponsored by another employer, self-sponsored or on dependent visa. This includes

Visa & Work Permit Application
Medical Fitness Test
ILOE Insurance
Emirates ID Biometric Enrollment
Health Insurance
Labor Card Issuance
Issuance of Electronic Residence Permit
Issuance of Emirates ID
📌 Processing typically takes 3 to 5 weeks depending on if you are a mainland or freezone company

💰 Step 4: WPS-Compliant Payroll Setup

Your company maybe subject to WPS regulations which requires all employee salaries are paid via the Wage Protection System (WPS) — a electronic platform that ensures salaries are paid accurately and on time.

To comply, your business must:

Register with a WPS-authorized bank or payroll provider
Pay salaries through the WPS portal by the monthly deadline
Ensure payroll aligns with the employment contract
Failure to comply can result in:

Penalties
Frozen licenses
Delays in future visa processing
📋 Step 5: Benefits & Leave Entitlements

UAE Labour Law (Federal Decree Law No. 33 of 2021) outlines minimum benefits all employees are entitled to, including:

Annual Leave: 30 calendar days per year after one year of service
Sick Leave: Up to 90 days per year, with varying pay structures
End of Service Gratuity: Based on final salary and years of service
Working Hours: Maximum 8 hours/day, 48 hours/week (with some exceptions)
📢 You can offer more generous benefits, but never less than what the law prescribes.

🔍 Step 6: Don’t Forget these Compliance Essentials

Here are some often-missed requirements that can cost companies time and money:

✅ Health Insurance: Mandatory across all emirates and needed as part of visa processing
✅ Job Descriptions: Should be aligned with the approved labor title
✅ Probation Period: Cannot exceed 6 months; termination rules apply
✅ Internal Policies: Disciplinary and Grievance are mandated by law but others are also highly recommended for consistency and protection

✅ Trackers & Register : Maintaining trackers and registers for leave, overtime, employee data and incidents are mandated by law

🌎 Final Thoughts

Hiring in the UAE is a structured process with multiple checkpoints — but done right, it gives you access to one of the most globally diverse and skilled workforces in the region.

With a planned and well mapped out process, you can be assured of seamless hiring process right from the start.
